Welcome to Abisiniya Travel & Tourism. Abisiniya provides services that enable people in the travel and tourism sector to connect with each other, build communities, and grow businesses. These Terms govern your use of Abisiniya, and the other products, features, apps, services, technologies. Abisiniya is a brand and service owned and operated by Globtorch Online Education and Business solutions.

This Terms of Service is a contract between you and Abisiniya that governs your access to and use of the Abisiniya service as either as a client, apartment or vehicle owner. You can add your apartment and vehicle for hire and we charge you 10% for every booking on your vehicle and your apartment.

1. Requirements for Registration

In order to use the Service, you hereby consent to provide and agree to complete all required information elements on the Service registration web pages. As a transporter you must register a valid vehicle and pay fees and other obligations arising from your use of the Service.

You undertake and agree to provide current, complete and accurate information and maintain it as current and accurate. We may require you to provide additional information as a condition of continued use of the Service.

By agreeing to this Terms of Service for Buyers, you represent that you are:

• 18 years old or older; and
• Capable of entering into a legally binding agreement.

2. Limitations on the Use of Service

We reserve the right to change, suspend or discontinue any aspect of the Service at any time, including hours of operation or availability of the Service or any Service feature, without notice and without liability.

We also reserve the right to impose limits on certain Service features or restrict access to parts or all of the Service without notice and without liability. We do not warrant that the functions contained in the Service will be uninterrupted or error free.

3. Prohibited Activities

You may not use the Abisiniya service for activities that:

• Violate any law, statute, ordinance or regulation.
• Relate to transactions involving:
  • Narcotics, steroids, certain controlled substances or other products that present a risk to consumer safety
  • Drug paraphernalia
  • Items that encourage, promote, facilitate or instruct others to engage in illegal activity
  • Stolen goods including digital and virtual goods
  • Items that promote hate, violence, racial intolerance, or the financial exploitation of a crime
  • Items that are considered obscene
  • Items that infringe or violate any copyright, trademark, right of publicity or privacy
  • Certain sexually oriented materials or services
  • Ammunition, firearms, or certain firearm parts or accessories
  • Certain weapons or knives regulated under applicable law

4. Important Notice

This is an important document which you must consider carefully when choosing whether to use the Services at any time. Please read the terms of this Agreement carefully before agreeing to it.

You are solely responsible for understanding and complying with any and all laws, rules and regulations of your specific jurisdiction that may be applicable to you in connection with your use of the Abisiniya Services.

Abisiniya is not part of contracts entered into by parties that meet on the Abisiniya platform. By acceptance of these terms the user indemnifies Abisiniya from any liabilities or claim for damages that may arise out of such contracts.

5. Termination of Service

We may, in our sole and absolute discretion without liability to you or any third party, terminate your use of the Service for any reason, including without limitation inactivity or violation of this Terms of Service.

Upon termination of your use of the Service, you remain liable for all Payment Transactions and any other obligations you have incurred.

6. Our Relationship

Abisiniya serves as a meeting place for transporters, entities that have goods to be carried and service providers to transporters.

6.1 Your Privacy

Protecting your privacy is very important to Abisiniya. Please review our policy in order to better understand our commitment to maintaining your privacy, as well as our use and disclosure of your Information.

6.2 Intellectual Property

The URLs representing the Abisiniya website(s), "Abisiniya," and all related logos of our products and services described in our website(s) are either copyrighted by Abisiniya, trademarks or registered trademarks of Abisiniya or its licensors.

6.3 Assignment

You may not transfer or assign any rights or obligations you have under this Agreement without Abisiniya's prior written consent. You are not permitted to transfer your Account to a third party.

6.4 Notices

We will communicate with you in the language(s) in which we have made available this Agreement to you. You agree that Abisiniya may provide notice or other information to you by posting it on the Abisiniya website(s), emailing it to your registered email address, or other electronic means.

6.5 Transaction History

Unless your Account is restricted, you can access your details of executed payment transactions and other information relating to your Account transaction history by logging into your Account.

6.6 Amendments to this Agreement

We may at any time amend, delete or add to this Agreement by giving notice of such Change by posting a revised version of this Agreement on the Abisiniya App. If you do not accept any Change, you must close your Account.

7. Eligibility

To be eligible for our Services, you must:

• Have full legal capacity to enter into a contract; and
• If you are an individual, be at least 18 years old

Abisiniya may, from time to time, make available to you other methods or procedures for you to obtain "Verified" status. By highlighting a User as "Verified" Abisiniya only represents that the Verified user has completed the steps of the process to obtain "Verified" status.

8. Restricted Activities

In connection with your use of our website, your Account, or the Services, you will not:

• Breach this Agreement or any other agreements
• Breach any law, statute, contract, or regulation
• Infringe Abisiniya's or any third party's intellectual property rights
• Act in a manner that is obscene, defamatory, libellous, unlawfully threatening or harassing
• Provide false, inaccurate, or misleading Information
• Fail to provide us with further information about you or your business activities
• Refuse to cooperate in an investigation
• Use an anonymising proxy
• Control an Account linked to another Account that has engaged in Restricted Activities
• Conduct your business in a manner that results in complaints, disputes, or other liability
• Abuse our Online Dispute Resolution process
• Disclose or distribute another User's Information to a third party
• Send unsolicited email to a User
• Take any action that imposes unreasonable load on our infrastructure
• Facilitate any viruses, Trojan horses, worms, or other malicious code
• Use any robot, spider, or automatic device to monitor or copy our website
• Interfere with our website or the Services
• Copy, reproduce, or alter any content from our website without consent
• Take any action that may cause us to lose services from our providers
• Reveal your Account password(s) to anyone else

9. Keeping Your Account Safe

You agree to perform the following actions to keep your Payment Instrument safe:

• Not engage in any of the Restricted Activities
• Keep the details of your password safe
• Not allow anyone else to have or use your password details
• Not disclose your username or password except when using the Service
• Never write your password in a way that can be understood by someone else
• Not choose a password that may be easy to guess
• Take care to make sure that no one sees your password when you use it
• Comply with all reasonable instructions regarding login security

10. Your Liability – Actions We May Take

You are responsible for all Reversals, fees, fines, penalties and other liability incurred by Abisiniya, or a third party caused by your use of the Services and/or arising from your breach of this Agreement.

If we have reason to believe that you have engaged in any Restricted Activities, we may take various actions including:

• Contact third parties and disclose details of the Restricted Activities
• Request information from you or update inaccurate Information
• Refuse to provide our Services to you in the future
• Take legal action against you

11. Data Policy

Abisiniya reserves the right to request additional information from you, and you agree to comply with any request for further information as we reasonably require to enable us to provide a safe service for all users.

Information and content you provide through usage, transactions and information provided by other users about you will be used to:

• Improve our service to you
• Provide measurements, analytics and other business services
• Promote safety, integrity and security for users
• Communicate with you from us or our partners for marketing purposes
• Research and innovation for social good

12. Governing Law and Jurisdiction

This Agreement and the relationship between us shall be governed by Republic of Zimbabwe laws. For complaints that cannot be resolved otherwise, you submit to the non-exclusive jurisdiction of the Republic of Zimbabwe courts.

13. No Waiver

Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches.

14. Limitations of Liability

Abisiniya and its parent stakeholders hold no (zero) liability for any activity related to your Abisiniya account.

15. No Warranty

We provide the Services to you subject to your statutory rights but otherwise provided without any warranty or condition, express or implied, except as specifically stated in this Agreement.

Abisiniya does not have any control over the products or services that are paid for with our Service and cannot ensure that a buyer or seller you are dealing with will actually complete the transaction.

16. Definitions

• "Account" or "Abisiniya Account" means a Personal, Business or Premier Account.
• "Agreement" means this agreement including all subsequent amendments.
• "Business Days" means a day (other than a Saturday or Sunday).
• "Calendar year" means 1 January to 31 December inclusive in any year.
• "Claim" means a challenge to a payment that a sender files directly with Abisiniya.
• "Customer Service" is Abisiniya's customer support accessible via our website.
• "Days" means calendar days.
• "Dispute" means a dispute filed directly with Abisiniya in the Online Resolution Centre.
• "Fees" means those amounts stated in our fee schedule.
• "Information" means any confidential and/or personally identifiable information related to an Account or User.
• "Abisiniya," "we," "us" or "our" means Abisiniya and its member institutions.
• "Services" means all payment services and related products available through our website.
• "User," "you" or "your" means you and any other person or entity using the Service.
• "Verified" means that you have completed our verification process to help establish your identity.
